If you are a third grade family and register early and we need to refund you, we will process the refund less the credit card processing fee.

Participation agreement
Liability waiver

Kipling PTO Waiver and Release I certify that I am the parent or legal guardian of the child I am registering for these activities (the “Participant”), and hereby consent for the Participant to participate in activities organized by the Kipling PTO (the “Program”). I execute this agreement, waiver and release on their behalf, as well as my own, my heirs and my assigns. As a condition of the Participant’s participation in the Program, I agree to the terms, policies and all rules and regulations of the Program. I further agree to the rules and policies of the Kipling ASE program and understand that such rules and policies are incorporated by reference as if fully set forth herein. Voluntary Participation and Assumption of Risks.

 

The Participant and their legal guardian(s) acknowledges that activities organized by the Kipling PTO, its officers, directors, employees, volunteers and agents (“Kipling PTO”) may be subject to certain hazards foreseen and unforeseen associated with and inherent to participating in physical and recreational activities. The specific risks vary from: (1) minor injuries such as scratches, insect bites, bruises and sprains, to (2) major injuries such as eye injuries or loss of sight, broken bones, joint or back injuries, heart attacks, and concussions, to (3) catastrophic injuries including paralysis and death. The Kipling PTO will take reasonable safety precautions to mitigate these risks, but the Participant and their legal guardian(s) understands that, notwithstanding such safety precautions, Kipling PTO cannot guarantee that the Participant may not be injured. Furthermore, the Participant and their legal guardian(s) acknowledges that the Participant may have a condition(s) that amplifies these risks and that the Kipling PTO may not provide special accommodations and does not provide any assurance and/or guarantee that the Participant may not be injured as a result of such conditions. The Participant and their legal guardian(s) have, nonetheless, decided to voluntarily participate in the Program. Liability Release. The Participant and their legal guardian(s) agree that the Kipling PTO will not be liable for any action taken or omitted to be taken by the Kipling PTO in connection with or in any way related to the Program.

 

The Participant and their legal guardian(s) understand and agree that the Kipling PTO will not be responsible for the operation and management of the facilities that may be used or visited in connection with the Program, or for the actions or inactions of any third parties, or for any damage or claim arising therefrom. The Participant and their legal guardian(s) hereby waive, release and discharge any and all claims for damages, including for personal injury, death or property damage, which they or any other individual may have, or which may hereafter accrue to such individuals, as a result of the Participant’s participation in the Program. The Participant and their legal guardian(s) covenant not to sue in a court of law or equity or to otherwise pursue legal action against the Kipling PTO relating to any claims or losses that may arise out of the Participant’s participation in this Program. Indemnification.

 

Participant and their legal guardian(s) hereby release, indemnify, and agree to hold harmless, to the fullest extent permitted by law, the Kipling PTO from and against any and all loss, claims, damages, liabilities, or actions (including reasonable attorneys’ fees) in any way arising out of, connected with, or attributable to the Participant’s participation in the Program, even to the extent to that such loss, claims, damages, liabilities, or actions arise from the negligence or alleged negligence of Kipling PTO, or from any general medical treatment, or emergency medical treatment rendered to the Participant in the event of need.


Code of Conduct

I fully understand that participation in PTO activities is a privilege and behavior issues will be discussed with parents/guardians as needed and, if unable to be remedied, could result in dismissal from the theater program at the discretion of the PTO, and without a refund.


Assignment of roles

Following auditions, parts in the play will be assigned.  I understand that my child is committing to participate in the play regardless of which role they receive and that children who drop out of the play following auditions will not be entitled to a refund.
